Biography
Rachel Guenther is an immigration attorney in the early stages of her career, focusing on employment-based and humanitarian immigration relief. After earning her Bachelor’s in Spanish, she served as Volunteer Coordinator with the AmeriCorps VISTA program at a Day Center for the unhoused in Madison, Wisconsin. She then worked as a legal assistant for The Madison Office of the Wisconsin State Public Defender, which solidified her decision to pursue a legal career.
At Kodem Law, Rachel particularly enjoys collaborating with artists and athletes to navigate U.S. immigration law. She collaborates with technology organizations, including startups and research facilities, to navigate immigration law and ensure regulatory compliance. She handles non-immigrant visas (H, L, O, P, U, T), labor certifications (PERM), and some permanent residence applications (EB-1A, EB-1B, EB-1C). She also assists with complex filings, appeals, and denials, such as responses to Requests for Evidence, Notices of Intent to Revoke, BALCA appeals, and Motions to Reconsider on petition denials.
Rachel’s understanding of the intersection between Criminal and Immigration law drives her commitment to advocating for immigrant rights, particularly for victims of crime or torture. Notably, her support on a Humanitarian Parole petition reunited an Afghan family with their U.S. citizen relatives.

Why do I practice U.S. immigration law?
Through my undergraduate studies, I saw the impact the U.S. Criminal Justice/Legal system has on U.S. citizens. However, it was the overwhelming burden placed on foreign nationals interacting with the system that inspired my choice to practice immigration law. I firmly believe this country can offer the American Dream to those who pursue it. I also understand that empathetic and passionate advocates are crucial to the process. I am happy to play a small but critical part in navigating the intricacies of immigration laws and helping immigrants achieve their American Dreams.
